Terms of Service

Welcome to Toegle, the service provider that turns your smartphones into emergency secure cameras, with  push notification features that alert you whenever something is going on, and allows you to be in the know wherever you are. This page explains the terms by which you may use our online and/or mobile Services, website, and software provided on or in connection with Toegle’s Services and features (collectively, the “Services”). By accessing or using the Services and by logging in, you electronically represent (“sign”) that you agree to the above terms and further certify that you have read, understood, and completely agree, to be legally bound by Toegle’s Terms of Service (this “Agreement”). This Agreement further applies to all visitors, users, and others who access the Services (the “Users”). Toegle reserves the right to make changes to this Agreement at any time without notifying you or the Users. As a user, you are solely responsible for reading the most current version of the terms and conditions.

Privacy Policy
Your privacy and safety is the utmost important issue for us. We created our Privacy Policy to make important disclosures about how you use Toegle to capture, view, and store video,  and how we collect and may use the personally identifiable information (“Personal Information”) and videos or anything you or other Users post on Toegle that would not be included in the definition of Personal Information. (“Content”) you enter on our Services.
The Toegle team has built a sophisticated and easy-to-use emergency monitoring system through your smartphone. We will not request for your personal information unless we are obligated to do so. We will not share or store any personal information unless required for the operation or the programming, by laws, or to conduct product development. We are committed to providing you with transparency into our privacy practices and control over your data in connection with the Services.

Personal Information and Content

We receive and store any Personal Information and Content you enter or upload to our Services. The types of Personal Information and Content collected may include, but are not limited to:
• Camera locations and names, that you are asked to enter and may change at any time.
• Video and audio signals and data are recorded and processed, depending on how you may have configured your Services. This may include Toegle sending you portions of the Content as part of a notification, or analyzing the data to identify motion or other events. If you have recording features enabled, we will capture, process and retain video and audio recordings from your device, of which you will be able to access, for the duration of your recording subscription period.
• You may save and choose to share Content for others to access using the Services. We will collect and store information required for us to save or share your Content.
• We may also draw upon this Personal Information and Content in order to modify and customize the Services to better suit your needs, to improve the effectiveness of our network and Services, and to develop new tools to enhance usability and security. Under no circumstance will any employee or agent of Toegle ever look at your private videos within your account unless given express consent to do so.

Information we receive from third parties and Cookies

We may receive and store information from third parties that interact with the Services or that provide services to us in connection with our operation and the Services, mostly to collect data and monitor application usage and performance. Toegle will provide your Personal Information to these 3rd party Services solely for the purposes noted above. In addition, you may choose to use third party apps that share with Toegle the Personal Information, activities and/or content you provide to those third party apps. In such case, we would like to remind you to please read the privacy policy of any such app so that you understand its sharing practices. We will also use cookies to identify each user.

You Are Always In Control

We assure you that you are the sole person who may choose to share your Personal Information. We neither rent nor sell your Personal Information to anyone, though we may provide aggregate, non- personally identifiable information to our partners. The default setting for all Personal Information and Content is to make that information visible only to others in the private groups you create or join on Toegle. You may modify that setting as part of the Services. Toegle may only share your Personal Information and Content only as described in this Privacy Policy, except for when required by law or applicable authorities to release the information.

Is Personal Information About Me Secure?

Your Personal Information is protected on Toegle by your username and password. We highly recommend that you select and protect your password appropriately, and limit access to your computer and mobile phone to only those individuals whom you trust to prevent unauthorized access to your account and to your Personal Information and Content. Toegle endeavors to safeguard Personal Information and Content to ensure that information is kept private, through physical, electronic, and procedural measures.

Eligibility and Safety

You may use the Services only if you can form a binding contract with Toegle and only in compliance with this Agreement and all applicable local, state, provincial, national, and international laws, rules and regulations. Anyone is or under age 13 is strictly prohibited from using the Services. The Services is not available to any Users previously removed from Toegle, whether for violation of this Agreement or otherwise. Furthermore, you represent and warrant the followings:

1. You are 13 years of age or older.

2. You understand that Toegle DOES NOT become involved in transactions or actions between or amongst parties and does not certify, investigate, or in any way guarantee the legal capacity of any party to transact.

3. You are responsible for obeying all applicable enforcement mechanisms, including, but not limited to federal, state, municipal, and tribal statutes, rules, regulations, ordinances, and judicial decisions, any applicable executive orders, including compliance with all applicable privacy protection requirements.

4. You will not use Toegle’s Services for any illegal purpose.

5. You consent to having your personal data transferred to and processed in the Toegle Server.

6. If you are located in a country embargoed by the United States, or are on the U.S. Treasury Department’s list of Specially Designated Nationals you will not engage in commercial activities on Toegle (such as advertising or payments).
   We do our best to keep Toegle safe, but we cannot guarantee it. We need your help to keep Toegle safe, which includes the following commitments by you:

7. You will not collect Users’ content or Personal Information, or otherwise access Toegle, using automated means (including, but not limited to, harvesting bots, robots, spiders, or scrapers) without our prior written permission.

8. You will not upload viruses or other malicious code.

9. You will not solicit login information or access an account belonging to someone else. You will not bully, intimidate, or harass any User.

10. You will not post content on Toegle that: is hate speech, threatening, or pornographic; incites violence; or contains nudity or graphic or gratuitous violence.

11. You will not develop or operate on Toegle a third-party application containing alcohol-related, dating or other mature content.

12. You will not use Toegle to do anything unlawful, misleading, malicious, or discriminatory.

13. You will not do anything that could disable, overburden, or impair the proper working or appearance of Toegle, such as a denial of Services attack or interference with page rendering or other Toegle functionality.

14. You will not facilitate or encourage any violations of this Agreement or our policies.
    You must provide us with your real personal information. Additionally, to further ensure account liability and registration security, you must adhere to the following conditions
    • You may never use another User’s account without their permission.
    • When creating your own account, you must provide accurate and complete information. You will keep your contact information accurate and up-to-date.
    • You are solely responsible for the activity that occurs on your account, and you must keep your account password secure. You will not share your password, let anyone else access your account without your permission, or do anything else that might jeopardize the security of your account.
    • If we disable your account, you will not create another one without our written permission.
    • You will not use Toegle if you are a convicted sex offender.
    • You will not transfer your account to anyone without first getting our written permission.
    • If you select a username or similar identifier for your account, we reserve the right to remove or reclaim it if we believe it is appropriate (such as when a username may infringe the rights of a trademark owner).
    • You will provide Toegle an email address of which you consent to our use of that email address to send you Services-related notices, including any notices required by law, in lieu of communication by postal mail.
    You must notify Toegle immediately of any breach of security or unauthorized use of your account. Toegle will not be liable for any losses caused by any unauthorized use of your account. You will not provide any false personal information on Toegle, or create an account for anyone other than yourself.
    You are solely responsible for any and all consequences of such your actions. You further acknowledge and understand that in the event that you violate these terms, Toegle may permanently remove you from the Services or the site, and depending on the nature and severity of the violation, avail itself of such remedies as are prescribed by law. Toegle will comply with applicable federal, state, provincial, municipal, and tribal law enforcement entities pursuant to applicable laws and regulations. You must take responsibility for your actions whilst using Toegle and take responsibility for any and all of your actions related to, or resulting from, my use of Toegle.

Sharing Your Content and Information

You own all of the content and Personal Information you enter or post on Toegle, and can control how it is shared through your privacy and application settings. In addition: for content that is covered by intellectual property rights such as videos, you specifically give us the following permission, subject to the limitations set forth in our Privacy Policy: you grant us a non-exclusive, perpetual, irrevocable, transferable, sub-licensable, royalty-free, worldwide license to use any Content that you post on or in connection with Toegle.
Furthermore, although we always appreciate your feedback or other suggestions about Toegle, you understand and acknowledge that we may use them without any obligation to compensate you for them, just as you have no obligation to offer them to us.

Protecting Other People’s Rights

We respect other people’s rights, and expect you to do the same. You will not post content or take any action on Toegle that infringes, misappropriates or violates someone else’s rights or otherwise violates applicable laws, rules or regulations. We reserve the right to remove any content or Personal Information you post on Toegle if we believe that it violates this Agreement or our policies. If you infringe other people’s intellectual property rights, we reserve the right to disable your account when we, in our sole discretion, deem it appropriate. Lastly, you will not post anyone’s identification documents or sensitive financial information on Toegle.

Mobile and Other Devices

We currently provide our mobile Services for free, but please be aware that your carrier’s normal rates and fees, such as text messaging fees and data fees, will still apply. You provide consent and all rights necessary to enable Users in your Toegle groups to sync (including through an application) their devices with any of your Content and Personal Information that is visible to them on Toegle.

Paid Upgrade and Refund

Toegle offers two paid upgrades. Toegle Plus is a one-time fee for mothly package. Toegle Premium is a monthly subscription service package. The payment goes through Google Play Store, App Store, and PayPal. Therefore, it has to abide by rules of these platforms. We can only issue refunds under exceptional circumstances.

Special Provisions Applicable to Software

If you download our software, such as a stand-alone software product or a browser plugin, you agree that from time to time, the software may download upgrades, updates and additional features from us in order to improve, enhance and further develop the software. You will not modify, create derivative works of, decompile or otherwise attempt to extract source code from us, unless you are expressly permitted to do so under an open source license or we give you express written permission.

Limitation of Liability

The Services provided herein are provided “as is” and without warranty of merchantability or warranty of fitness for a particular purpose or any other warranty, express or implied. Toegle makes no representation or warranty that the Services or the use of Toegle app will not infringe any other patent or other proprietary rights. In no event shall Toegle be liable for any incidental, special or consequential damages resulting from exercise of the license granted herein or the use of the Services.
Furthermore, Toegle is not responsible for addressing any claims you have or any claims of any third party relating to the Services, the Toegle app or your possession and use of the Toegle app, including, but not limited to: (i) product liability claims; (ii) any claim that the Toegle app fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection or similar legislation.
Neither Toegle nor its supplies shall be responsible or liable with respect to any subject matter of this Agreement or terms or conditions related thereto under any contract, negligence, strict liability or other theory (a) for loss or inaccuracy of data or cost of procurement of substitute goods, Services, or technology, or (b) for any indirect, incidental, or consequential damages including, but not limited to loss of revenues and loss of profits. Certain states and/or jurisdictions do not allow the exclusion of implied warranties or limitation of liability for incidental or consequential damages, so the exclusion set forth above may not apply to you.
You agree to indemnify and hold harmless Toegle and all of its owners, directors, officers, employees, and agents for any and all loss, harm, damage, costs, liability, and expense caused to them, whether intentionally or unintentionally, by my use of Toegle, including but not limited to direct or indirect results of violations of any and all applicable laws.

Termination

If you violate the letter or spirit of this Agreement, or otherwise create risk or possible legal exposure for us, we reserve the right stop providing all or part of Toegle to you. We will notify you by email or at the next time you attempt to access your account. You may also uninstall your application at any time.

Disputes

Any and all disputes, controversies, differences, or claims (“Disputes”) which may arise between you and Toegle hereto out of or in relation to the interpretation or the performance of this Agreement shall be settled between the parties hereto by arbitration according to the Rules of Conciliation and Arbitration of the International Chamber of Commerce by one or more arbitrators to be appointed in accordance with such Rules, by which each Party hereto is finally bound. The arbitration proceeding shall be conducted in the English language. Either Party may initiate arbitration proceedings at a location selected by the other Party. Judgment upon the award rendered by the arbitrator(s) may be entered in any Court having jurisdiction or application may be made to such court for a judicial acceptance of the award and/or an order of enforcement, as the case may be. The arbitral award shall be final and binding upon the Parties.
WE DO NOT GUARANTEE THAT TOEGLE WILL ALWAYS BE SAFE, SECURE OR ERROR-FREE OR THAT TOEGLE WILL ALWAYS FUNCTION WITHOUT DISRUPTIONS, DELAYS OR IMPERFECTIONS. TOEGLE IS NOT RESPONSIBLE FOR THE ACTIONS, CONTENT, INFORMATION, OR DATA OF THIRD PARTIES, AND YOU RELEASE US, OUR DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS FROM ANY CLAIMS AND DAMAGES, KNOWN AND UNKNOWN, ARISING FROM OF OR IN ANY WAY CONNECTED WITH ANY CLAIM YOU HAVE AGAINST ANY SUCH THIRD PARTIES.

Other

This Agreement makes up the entire agreement between the parties regarding the Services, and supersedes any prior agreements, whether written or oral. If any portion of this Agreement is found to be unenforceable, the remaining portion will remain in full force and effect. If we fail to enforce any provision of this Agreement, it will not be considered a waiver of that provision or of any other provision of this Agreement. You will not transfer any of your rights or obligations under this Agreement to anyone else without our written consent. All of our rights and obligations under this Agreement are freely assignable by us in connection with a merger, acquisition, or sale of assets, or by operation of law or otherwise. Nothing in this Agreement shall prevent us from complying with applicable laws, rules or regulations. This Agreement does not confer any third party beneficiary rights. We reserve all rights not expressly granted to you. You will comply with all applicable laws when using or accessing Toegle. Any amendment to or waiver of this Agreement must be made in writing and either signed by us or posted by us on the Services. Toegle may amend this Agreement from time to time, at its sole discretion. If we make material changes to the way we use Personal Information or Content, we will notify you by posting an announcement on our Services or by sending you an email to the address you have registered with us. Users will be bound by any changes to the Agreement when they use the Services after they have first been notified of such changes.

귀하의 개인 정보는 귀하의 사용자 이름과 비밀번호로 Toegle에서 보호됩니다. 암호를 적절히 선택하여 보호하고 계정과 개인 정보 및 콘텐츠에 대한 무단 액세스를 방지하기 위해 신뢰하는 개인에게만 컴퓨터 및 휴대 전화에 대한 액세스를 제한하는 것이 좋습니다. Toegle은 개인 정보 및 콘텐츠를 보호하여 물리적, 전자적 및 절차 적 조치를 통해 정보가 비공개로 유지되도록 노력합니다.

자격 및 안전

귀하는 Toegle과 계약을 맺고 이 계약 및 모든 해당 지역, 주, 지방, 국가 및 국제 법률, 규칙 및 규정을 준수하는 경우에만 서비스를 사용할 수 있습니다. 13 세 이하의 사람은 서비스 사용을 엄격히 금지합니다. Toegle로부터 이전에 제거 된 사용자는 서비스를 사용할 수 없습니다. 또한 귀하는 다음을 진술하고 보증합니다 :

4.     불법적인 용도로 Toegle을 사용하지 않습니다.

5.     귀하는 귀하의 개인 데이터가 Toegle Server로 전송되고 처리되는 것에 동의합니다.

8.     바이러스 나 다른 악성 코드는 업로드하지 않습니다.

9.     로그인 정보를 요청하거나 다른 사람의 계정에 액세스하지 않습니다. 사용자를 괴롭히거나 협박하거나 괴롭히지 않습니다.

10.  Toegle에 콘텐츠를 게시하지 마세요 : 증오 성 발언, 협박 또는 포르노; 폭력을 선동한다. 누드 또는 그래픽 또는 무상의 폭력을 포함합니다.

11.  Toegle과 관련된 알콜 관련, 날짜 또는 기타 성숙한 콘텐츠가 포함 된 제 3 자 애플리케이션을 개발하거나 운영하지 않습니다.

12.  불법, 오도, 악의 또는 차별적 인 행위를하기 위해 Toegle를 사용하지 않습니다.

13.  서비스 거부 공격이나 페이지 렌더링 또는 기타 Toegle기능에 대한 간섭과 같이 Toegle의 적절한 작동이나 모양을 사용 불가능하게하거나, 과부하 시키거나, 손상시킬 수 있는 일은 하지 마십시오.

14.  귀하는 본 계약 또는 Google 정책 위반을 조장하거나 장려하지 않습니다. 
       귀하는 실제 개인 정보를 저희에게 제공해야합니다. 또한 계정 책임 및 등록 보안을 위해 다음 조건을 준수해야합니다. 
       • 사용자의 허가없이 다른 사용자의 계정을 사용할 수 없습니다. 
       • 자신의 계정을 만들 때 정확하고 완전한 정보를 제공해야합니다. 연락처 정보를 정확하고 최신으로 유지합니다. 
       • 귀하는 귀하의 계정에서 발생하는 활동에 대해 전적으로 책임을 지며 귀하의 계정 암호를 안전하게 지켜야합니다. 귀하는 귀하의 암호를 공유하지 않으며, 귀하의 허락없이 다른 누구에게도 귀하의 계정에 액세스 시키거나 귀하의 계정 보안을 위태롭게 할 수 있는 다른 방법을 취하지 않을 것입니다.
       • 귀하가 귀하의 계정을 사용할 수 없게 된 경우, 우리는 서면 허가없이 다른 계정을 만들지 않습니다. 
       • 유죄 판결을 받은 성범죄자인 경우 Toegle은 사용하지 않습니다. 
       • 귀하의 서면 허가 없이는 누구에게도 귀하의 계정을 양도하지 않습니다. 
       • 귀하의 계정에 사용자 이름 또는 유사한 식별자를 선택하면, 사용자 이름이 상표권자의 권리를 침해 할 수 있다고 판단되는 경우, 우리는 적절하다고 판단되는 경우 사용자 이름 또는 유사한 식별자를 선택하거나 제거 할 수 있는 권리를 가집니다.

        보안 위반이나 계정 무단 사용에 대해 Toegle에 즉시 통보 해야합니다. Toegle은 귀하의 계정을 무단으로 사용함으로써 발생하는 어떠한 손실에  대해서도 책임을지지 않습니다. Toegle에 허위의 개인 정보를 제공하거나 자신 이외의 다른 사람의 계정을 만들지 않습니다.
        귀하는 귀하의 행동으로 인한 모든 결과에 대해 전적으로 책임을 집니다. 귀하는 이 약관을 위반하는 경우 Toegle이 귀하를 서비스 또는 사이트에서 영구적으로 퇴거시킬 수 있으며, 위반의 성격 및 심각도에 따라 법으로 정한 구제 조치를 취할 수 있음을 인정합니다. 귀하는 Toegle에 입력하거나 게시하는 모든 컨텐츠 및 개인 정보를 소유하며 개인 정보 및 응용 프로그램 설정을 통해 공유 방법을 제어 할 수 있습니다. 또한 동영상과 같은 지적 재산권이 적용되는 콘텐츠의 경우 Google 개인 정보 취급 방침에 명시된 제한 사항에 따라 귀하에게 구체적으로 다음과 같은 허가를 제공합니다. 귀하는 비 독점적이고 영구적이며 취소 할 수 없으며 양도 할 수있는 Toegle에 게시하거나 Toegle과 관련하여 게시하는 모든 콘텐츠를 사용할 수 있는 라이센스 가능한 무료 사용권. 
또한 Toegle에 대한 귀하의 의견이나 다른 제안에 항상 감사하지만, 귀하는 저희에게 제공 할 의무가 없듯이 귀하를 보상 할 의무가 없음을 이해하고 인정합니다.

다른 사람들의 권리 보호

우리는 다른 사람들의 권리를 존중하며 귀하가 그와 같은 행동을 할 것을 기대합니다. 귀하는 다른 사람의 권리를 침해, 남용 또는 위반하거나 해당 법률, 규칙 또는 규정을 위반하는 컨텐츠를 게시하거나 Toegle에 취할 조치를 취하지 않습니다. 우리는 Toegle가 귀하가 본 계약 또는 본 정책에 위배된다고 판단되는 경우 Toegle에 게시 한 컨텐트 또는 개인 정보를 삭제할 권리가 있습니다. 다른 사람의 지적 재산권을 침해하는 경우, 당사는 단독 재량에 따라 귀하의 계정을 사용 중지 할 권리를 보유합니다. 마지막으로 Toegle에 신분 확인 서류 또는 민감한 재무 정보를 게시하지 않습니다.

유료 업그레이드 및 환불
